This Personal Data Protection Notice (“Notice”) outlines Tips Industry (M) Sdn. Bhd. on compliance with the Malaysia’s Personal Data Protection Act 2010 (“PDPA”). This policy applies and issues to all divisions, employees, subsidiaries, associated, related and affiliated companies of Tips Industry (M) Sdn. Bhd., where applicable (collectively referred to as “Tips”, “we” or “us”) and Tips immediate and/or prospective customers, suppliers or agents or service providers unless we have notified you otherwise in writing.

1. Purpose of Collection of Personal Data

1.1 In the course of your dealings with Tips, we may request that you provide data and information about yourself (“Personal Data”) which may include, but not limited, to your name, company industry, postal address, e-mail address, NRIC/Passport number, photograph or video image of an individual, mobile telephone number and any other personal information related to you for the purpose to:-

provide notices, services or products or corporate information, newsletters and the promotion and marketing material of our products and services whether present or future to you;
communicate with you;
process your request and/or application;
perform research, assessment/statistical and analysis exercise;
customer relationship management procedures for example to deal with customer’s feedback;
or comply with legal obligations.

and you agree and consent to Tips using and processing your Personal Data in the manner as identified in this Notice.

2. Disclosure of Personal Data

2.1 Depending on the product or service concerned, your Personal Data may also be disclosed to:-

Tips, its related companies and those established in the futures;
Tips’ holding company outside Malaysia;
Tips’ external advisors, service providers, agents, consultants and insurers;
Tips’ business associates that provide related services and products in connection with Tips business; or
courts, arbitrations, tribunals and regulatory authorities in accordance to law.

2.2 We may also be required to transfer your personal data outside of Malaysia for the purposes and to such third parties stated in this Notice. The transfer of your personal data outside Malaysia would also be required if you are travelling, residing or based outside Malaysia.

3. Safety of Personal Data

3.1 Reasonable effectors will be made to ensure that any Personal Data held by Tips is stored securely.

3.2 We require that organizations outside Tips which handle or obtain Personal Data as service providers and/or business associates of Tips under strict confidentiality undertakings or agreements to protect the confidentiality and Personal Data.

4. Your Rights of Access and Correction

4.1 Subject to any exceptions under applicable laws, you have the right to request access to or correction or rectification of your Personal Data or limit the processing of your Personal Data, or seek further information from us, and in this respect, you may:-

check whether we hold or use your Personal Data and request access to such data;
request that we correct any of your Personal Data that is inaccurate, incomplete or out-of-date; and
withdraw your Personal Data, in full or in part, your consent given previously from us.

4.2 In respect of your right to access and/or correct your Personal Data, we have the right to refuse your requests to access and/or make any correction to your Personal Data for the reasons permitted under law.

5. Obligation to Provide Personal Data

5.1 We acknowledge that you have the right to decide the personal data that you wish to provide to us. The provision of the personal data specified in Paragraph 1.1 above is voluntary in nature. However, please note that if you do not provide the personal data requested above or limit the way such information is to be processed, it may result in us not being able to:

communicate or correspond with you;
to provide our services to you; and/or
grant you access to our website.

6. General

6.1 Tips reserves its sole discretion to change, modify, add, amend, vary and/or remove any terms, in full or in part of this Notice at any time and you should check this page periodically for changes. You acknowledge and agree that by using this website and provide your Personal Data to us, you shall be deemed to be bound by terms and conditions set forth herein.

6.2 This Notice is issued both in Bahasa Malaysia and English languages. In the event of any conflict between the English and other language versions, the English version shall prevail.

7. Disclaimer

7.1 The accuracy and completeness of your personal data depends on the information provided by you. It shall be deemed that the information provided by you shall be accurate, up-to-date and complete unless you inform otherwise.

7.2 In the event you provide any third party’s personal data to us including but not limited to your employer, spouse, family member or friends), you represent and warrant that you are authorized to provide their personal data to us and you have obtained their consent for their personal data to be processed and used in the manner as set forth in this Notice.
